1. Acceptance

These Terms govern access and use of Chatbot iTech. By using the service you accept these Terms and our Privacy Policy.

2. Services

Chatbot iTech is a cloud-based messaging & CRM platform that supports WhatsApp, Instagram DM, Facebook Messenger, Email and Telegram. Services include automation flows, media support, CRM records, analytics and integrations with third-party providers.

3. Pricing & Billing

Pricing is subscription-based and depends on plan chosen. Pricing may change over time; customers will be notified of material changes. Certain additional services (WhatsApp Official API, approved templates, per-message charges, DFY setup) may incur extra fees billed separately. Payment terms are defined in invoices/orders.

4. Registration & Account

Customers must provide accurate business registration and contact details. Admin users are responsible for account access management and confidentiality of credentials. Two-factor authentication is recommended for admin accounts.

5. Acceptable Use

Customers shall comply with all applicable laws and platform policies (including Meta/WhatsApp policies). Prohibited activities include sending unsolicited spam to non-opted-in users, harassment, illegal content, or fraudulent activity. We reserve the right to suspend accounts violating these rules.

6. WhatsApp Official API & Templates

Integration with WhatsApp Official API requires partner approval and may incur extra fees; approval is subject to Meta/BSP review. Customers are responsible for template content and compliance with WhatsApp template rules. We assist in submission but final approval rests with Meta/BSP.

7. Data & Security

Customers remain controllers of personal data captured via Chatbot iTech. We act as a processor for such data and implement reasonable security measures (TLS, encryption-at-rest where applicable, RBAC, audit logs). DPAs available upon request.

8. Liability & Warranty

We strive for high availability but cannot guarantee uninterrupted service. To the maximum extent permitted by law, liability is limited to fees paid in the prior 12 months. We disclaim liability for indirect or consequential losses, including losses due to account suspension by platform partners (e.g., Meta) when policies are violated.

9. Termination & Suspension

We may suspend or terminate accounts for policy violations, fraud, illegal activities, or non-payment. Customers may terminate per subscription terms; fees may be non-refundable based on plan terms.

10. Indemnification

Customers indemnify iTech Digital from claims arising out of their content, violation of laws, or misuse of the platform.

11. Changes to Terms

We may update these Terms; material changes will be notified to customers. Continued use after notice constitutes acceptance.

12. Dispute & Governing Law

These Terms governed by the laws of Malaysia. Disputes will be resolved via negotiation and, if unresolved, by courts in Malaysia unless parties agree to arbitration.
